Effective October 28, 2026 · Version 2026-10-28 · Earlier versions
The short version
- We never sell your data, never show ads, and never use your data to train AI models.
- We collect what NOPE needs to work: your email, your quit profile and progress, purchase records, and basic diagnostics when something breaks.
- If someone else pays for your plan, they can't see your quit data. At most they see your email address, a name they typed for you, and whether you joined. A team asks you before you join.
- Delete your account any time. We erase your data, except for a few records the law makes us keep (see the table).
- Information about your smoking and quitting is health-related. Our Consumer Health Data Privacy Policy explains how we protect it.

1. Who we are
NOPE is run by Bit Microsystems LLC, 3640 Myrtle Avenue, Long Beach, CA 90807, USA. We are responsible for (the "controller" of) the personal data described here. Questions or requests: hello@quitwithnope.com.
This policy covers the NOPE app, quitwithnope.com and the emails we send. For team plans, the organisation that pays decides who to invite. We still decide how members' NOPE data is used, and this policy applies to it.
2. What we collect
| What | Details | Where it comes from |
|---|---|---|
| Account | Email address, and any other addresses you add and confirm (so invitations sent to them reach you); one-time sign-in and confirmation codes (short-lived); sign-in sessions; timezone; whether you're signed in on a phone or the web; the last date you signed in or opened NOPE; the marketing-email choice you made. | You and your device |
| Quit profile | First name or nickname; what you use (for example cigarettes, roll-ups, vapes, heated tobacco, nicotine pouches or cigars) and how much; price you pay; years of use; quit date and taper plan; triggers; "what's holding you back"; who NOPE is for (you, a gift, a team). | You, during setup and in Settings |
| Progress | What you log (cigarettes, vaping sessions, pouches and so on), cravings and how they went, optional journal notes, slips, milestones and awards; the affirmations written for you. | You, as you use the app |
| Notifications | A push token for your device, if you allow notifications; your local times for reminders. | Your device |
| Card purchases | Plan, price, dates, payment status, invoices and receipts; your name, billing email, billing country and postcode; card brand and last four digits; a record of the terms you accepted (the version and wording shown), when, the country you bought from and the IP address you bought from. Stripe holds your full card details. We never see or store them. | You, via Stripe checkout |
| App Store and Google Play purchases | Product, transaction IDs, status, renewal and expiry dates, and refund or cancellation events. No card details. | Apple or Google, via RevenueCat |
| Gifts and teams | If you buy: the name shown to recipients, your gift message, recipients' names and email addresses, delivery date, team name, company email domain, company billing details and tax ID, and a log of the invitations you sent. If you're invited or covered: the name (if any) and email address the buyer entered, when invitations and reminders were sent, whether and when you accepted, declined or left, and your seat status and dates. If you decline: whether you asked not to be invited again by that sender, or by anyone. | The buyer, and you when you respond |
| Diagnostics | When the app hits an error: an error message and technical details, the screen you were on, app and OS version, and a random ID stored in the app so related errors can be grouped (it's reset when you sign out or delete your account). While you're signed in, these reports are linked to your account so we can help you, and our admins can see them. Reports are designed not to include your journal notes or other things you type, and we remove email addresses, sign-in tokens and long codes before storing them. Kept for 30 days. | The app |
| Consents | When you agree to process your quit data, or confirm you're 18 or older and accept our Terms, a record of what you agreed to (the policy version), when, and whether it was in the app or on our website. At checkout, a record of the exact terms shown, when you accepted them, and the country and IP address you bought from (see Card purchases). | You, in the app or on our website |
| Cancellation answers | If you cancel a plan in the app or on the web: the reason you picked, anything you chose to type, the alternative we offered (such as a reminder or a pause) and what you chose. | You |
| Withdrawals | If you withdraw from a purchase under the EU, EEA or UK 14-day right: the date, the purchase and the refund, plus a scrambled (hashed) copy of your email address and the card fingerprint Stripe gives us (a code for the card, not its number), so we can spot repeated withdrawals. We never refuse a withdrawal because of this record. | You and Stripe |
| Invitation send log | Each email we send to someone on another person's behalf (gift and team invitations, reminders, admin invitations): a scrambled (hashed) copy of the address, the plan, the sender and when. This lets us limit how many invitations anyone can receive or send. | Us |
| Referral | The partner code you used, if a partner referred you. | You |
| Support | What you write to us and our replies. | You |
| Email events | Whether our emails were delivered or bounced, unsubscribes, and opens and clicks where your email app reports them. | Our email provider |
We don't collect your location, contacts, photos, health-app records or advertising identifiers. The app contains no advertising SDK and no third-party analytics SDK.
3. How we use it, and our legal bases
Where the GDPR or UK GDPR applies, we rely on these legal bases:
| Purpose | Legal basis |
|---|---|
| Signing you in; running your taper plan, stats, savings and recovery timeline; syncing so your progress survives a new phone | Contract (providing the Service you asked for). For quit data, which may count as health data: your explicit consent, given in the app before you enter any quit details |
| Writing your daily affirmations with an AI model, using your profile, progress and short journal excerpts (section 4), and sending them at the times you chose | Contract; explicit consent for quit data |
| Billing, receipts, renewals, reminders before trials and renewals, cancel and pause flows | Contract; legal obligation (consumer and tax law) |
| Delivering gifts and team invitations and a few reminders, telling buyers whether a seat was accepted, and recording team members' explicit choice to join | Contract with the buyer; our legitimate interest in delivering what they paid for (see section 7) |
| Releasing team seats that joined through a company email domain or join link but haven't been used for 120 days (using only the last date you signed in or opened NOPE), after warning you | Contract with the buyer; our legitimate interest in keeping paid seats available to people who use them |
| Understanding why people cancel (cancellation answers), to improve NOPE and our offers | Legitimate interest. Answers are optional |
| Fixing crashes and bugs from diagnostics | Legitimate interest in a working, secure app |
| Preventing fraud and abuse (for example repeat trials, chargebacks, invitation spam) and keeping the Service secure | Legitimate interest; legal obligation |
| Marketing emails (offers, stories and tips) | Consent where the law requires it (for example in the EU, EEA, UK and Canada); otherwise our legitimate interest. You can always opt out |
| Personalising marketing emails with your quit numbers or an AI-written note | Your consent. You can switch it off at any time |
| Keeping tax, accounting and dispute records, including proof of what you agreed to at checkout; responding to payment disputes; recording withdrawals; answering lawful requests | Legal obligation; legitimate interest in defending claims |
| Paying referral partners for sign-ups they sent us | Legitimate interest. Partners see counts and totals, never who you are |
Our staff can access account data only when it's needed for support, billing or security. Admin access is limited to a small number of people and every admin action is logged.
4. AI-written messages
Your daily affirmations, and some personal notes in emails if you've allowed it, are written by an open-source language model that runs on Cloudflare Workers AI. Cloudflare acts as our processor. To write a message we send the model the context it needs: your first name or nickname, what you're quitting, your plan stage and days to your quit date, how long you've used it, what you said holds you back, recent progress (cravings beaten, recent slips, money kept), your toughest trigger times, and short excerpts of your most recent journal notes so the message can echo your own words. The model keeps nothing after it answers. Neither we nor Cloudflare use your data to train AI models. We filter what the model writes and block medical claims.
5. Emails and notifications
- Service emails, which we send whenever they're needed: sign-in codes; purchase confirmations and receipts; trial, renewal and price-change notices; payment problems; pause and cancellation confirmations; gift and team invitations and updates.
- Marketing emails: offers (including after a plan ends), and about every 10 days a story, tip or quote for people who aren't subscribed. Unsubscribe with the link in any of these emails or by emailing us. Unsubscribing doesn't stop service emails.
- Push notifications: affirmations and reminders, only if you allow them. Turn them off in the app or your phone's settings.
6. Gift and team plans: what payers see
| How you got your seat | The payer can see | The payer can never see |
|---|---|---|
| The giver or your organisation invited you by email | Your email address and the name they typed for you, if they typed one (never the name or nickname you use in NOPE); whether you've been invited, have joined or have declined; when you were invited and joined; whether your seat is active or ending | Your profile, the name or nickname you use in NOPE, your plan, what you log, cravings, slips, journal notes, affirmations, progress, whether you're still using nicotine, when you last opened NOPE, or whether you pay for NOPE yourself |
| You joined through your organisation's email domain or a join link | Only totals, shown in bands (fewer than 5, 5–9, 10–24, 25–99, or 100 or more), so no one person can be picked out. Not your name or email |
Joining a team is always your choice. When a team invites you, NOPE asks you to confirm before you join and tells you exactly what the team will see. Until you tap Join, the team only sees that you've been invited. A gift starts when you sign in with the invited address, and you can decline or leave it.
You can leave in the app or at quitwithnope.com/account. We only tell the payer that a seat became free, not who left. If they invited people by email, though, they may be able to tell from their list that you're no longer on it.
Unused domain and join-link seats. If you joined through your organisation's email domain or a join link and haven't signed in or opened NOPE for 120 days, we email you, and release the seat 14 days later if you still haven't. We use only that last-open date, and the payer isn't told who was released.
If you buy a gift or team plan, recipients see your name (as you entered it), your message and, for teams, the team name.
7. If someone gave us your email address
If a friend bought you a gift or your organisation invited you, they gave us your email address, and maybe your name and a message. We use it only to deliver the invitation and a small number of reminders, to show the buyer whether you accepted, and to recognise you if you sign in with that address. Every invitation has a link to decline and stop further emails. If you decline, we remove your seat, tell the buyer the invitation was declined, and keep a scrambled (hashed) copy of your address so that sender can't invite you again for 12 months. On the same page you can also choose never to receive NOPE invitations from anyone. We then keep a hashed copy of your address for as long as that choice stands, and you can ask us to lift it at any time. We also keep a hashed log of the invitations we send for 35 days, so we can limit how many invitations anyone receives. If you never sign in, we delete the invitation within 90 days after the plan it belongs to ends.
8. Who processes your data
We use these service providers. Each acts on our instructions, gets only what it needs, and is bound by a data-processing agreement:
| Provider | What it does | Location |
|---|---|---|
| Cloudflare | Hosting, network and security; runs our API; Workers AI for affirmations | Global network, USA |
| DigitalOcean | Hosts our database server, which stores account, profile, progress and billing records. We run the database ourselves; our API reaches it through Cloudflare Hyperdrive over an encrypted connection | Amsterdam, the Netherlands (EU) |
| Stripe | Card payments, invoices, tax calculation and fraud screening for card purchases. Stripe is also an independent controller for some payment data | USA, EU |
| RevenueCat | Confirms App Store and Google Play subscription status | USA |
| Apple and Google | App distribution and store billing (each as an independent controller); push delivery (APNs and Firebase Cloud Messaging) | USA |
| Expo (650 Industries) | Relays push notifications to Apple and Google | USA |
| Brevo | Sends all our emails: sign-in codes, service emails, invitations and marketing | EU (France) |
| Google (Analytics, Fonts) | Website only: visit statistics and web fonts (section 10) | USA |
Payment disputes. If a card payment is disputed, we may give Stripe and the card network the records of that purchase: what was bought and when, the terms accepted at checkout and when, the country and IP address it was bought from, our receipts and emails, and account dates such as sign-ins. We never give them your quit data.
We may also disclose data if the law requires it, to protect people's safety or our rights, or to a buyer of our business, which would have to keep honouring this policy. If that ever happens, we'll tell you first.
9. What we never do
- We never sell your personal data, and we never "share" it for cross-context behavioural advertising, as California law defines these terms.
- We never show ads in the app, and we never give your data to advertisers or data brokers.
- We never use your data to train AI models, and we never let our providers do so.
- We never tell an employer or gift-giver anything about how your quit is going.
10. This website
quitwithnope.com uses Google Analytics 4 to count visits and see which pages and links people use. Google Analytics sets cookies and receives your IP address, approximate location, device and browser type, and the pages you view. We use it only in aggregate to understand which marketing works. It is never joined to your NOPE account, and we don't use it for advertising or remarketing. The site also loads fonts from Google Fonts, so Google receives your IP address when a page loads.
11. International transfers
We're based in the United States, and most of our providers process data there. When we transfer personal data from the EU, EEA, UK or Switzerland, we rely on the European Commission's Standard Contractual Clauses (with the UK Addendum), or on the provider's certification under the EU-U.S. Data Privacy Framework and its UK and Swiss extensions, plus additional safeguards where needed. Ask us for a copy of the relevant safeguards.
12. How long we keep data
| Data | How long |
|---|---|
| Account, quit profile, progress, journal notes, affirmations | While your account exists. Erased when you delete your account |
| Sign-in codes and code-request logs | Up to 7 days |
| Diagnostics (error logs) | 30 days, and deleted earlier if you delete your account |
| Payment, invoice and tax records | As long as tax and accounting law requires, usually up to 7 years after the purchase. Kept even if you delete your account, with as little else as possible |
| Raw payment and store notifications (from Stripe and RevenueCat) | Personal details removed after 180 days |
| Records of terms you accepted at checkout (the exact wording, version, time, country and IP address) | At least 3 years after the purchase, and at least 1 year after the plan ends, whichever is later. If you delete your account, the IP address is removed and the rest is kept for that period |
| Cancellation answers | While your account exists. Erased when you delete your account |
| Withdrawal records (hashed email address and card fingerprint) | 3 years after the withdrawal |
| Invitation send log (hashed addresses) | 35 days |
| Records of the consents you gave in the app | While your account exists, and as long as we need them to show you consented |
| Unclaimed gift or team invitations, and team member lists | Deleted within 90 days after the plan they belong to ends |
| Free-trial use | If you used a free trial and then delete your account, a scrambled (hashed) copy of your email address, so a trial can't be restarted by signing up again |
| Marketing opt-outs | Kept as a scrambled (hashed) address so we keep honouring your choice, even after deletion |
| Declined invitations | A hashed address: 12 months for a decline of one sender's invitations; for "never send me NOPE invitations", until you ask us to lift it |
| Support emails | Up to 3 years after the conversation ends |
| Admin audit log | Up to 3 years, for security and accountability |
| Backups | Deleted data can remain in encrypted backups until they're overwritten on their normal rotation, and is never restored to active use |
When you delete your account, we also delete your contact from our email provider and your diagnostic logs. Apple, Google and Stripe keep their own records of your purchases under their own policies.
13. Security
Data is encrypted in transit (TLS). Payment secrets are encrypted at rest. Access is limited to people who need it, and we log admin actions. Sign-in uses one-time codes, so there's no password to steal. No system is perfectly secure. If a breach affects you, we'll tell you and the relevant authorities as the law requires.
14. Your rights
Wherever you live, you can ask us to:
- access your data or get a copy of it in a portable format;
- correct it (you can edit most of it yourself in the app);
- delete it: in the app (More → Danger zone → Delete account), at quitwithnope.com/account, or by email;
- stop marketing: use the unsubscribe link, or email us;
- withdraw consent you gave us, at any time. This doesn't affect anything we did before.
In the EU, EEA and UK you can also object to processing based on legitimate interests, ask us to restrict processing, and complain to your data protection authority (in the UK, the ICO). We'd appreciate the chance to fix things first.
To make a request, email hello@quitwithnope.com from your account email. If you write from another address, we may ask you to confirm your identity with a sign-in code. We reply within 30 days (45 days where US state law allows) and don't charge for requests.
15. US state privacy rights
Residents of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon and other states with privacy laws have the rights in section 14, and also:
- Right to know the categories of personal information we collect (section 2), where it comes from, why we use it (section 3), and the categories of providers we disclose it to (section 8). In the past 12 months we have disclosed identifiers, commercial information, internet activity, and sensitive information (health-related quit data) to service providers, for the purposes above. We have not sold or shared any of it.
- Sensitive personal information. We use health-related quit data only to provide the Service and as otherwise permitted by law, so there's nothing for you to limit. We never use it to infer things about you beyond your quit.
- Opt-out signals. We don't sell or share personal data. We still treat a Global Privacy Control signal as a request to opt out.
- No discrimination for using your rights.
- Authorised agents may make requests for you with your signed permission. We'll verify your identity with you directly.
- Appeals. If we decline your request, reply to our answer to appeal. We'll respond within the time the law sets. If you're still unhappy, you can contact your state attorney general.
Washington, Nevada and Connecticut residents: see our Consumer Health Data Privacy Policy.
16. Children
NOPE is for adults and isn't directed at anyone under 18. We don't knowingly collect data from children. If you think a child has given us their data, tell us and we'll delete it.
17. Changes and contact
If we change this policy materially, we'll tell you by email or in the app before the change applies, and ask for your consent where the law requires it. Earlier versions are kept at quitwithnope.com/legal.
