Terms of Use
This is the permanent copy of version 2026-10-28 (October 28, 2026). Read the current version · all legal documents.
Effective October 28, 2026 · Version 2026-10-28 · Earlier versions
Already had a NOPE account before this version? It applies to you 30 days after we tell you about it by email or in the app (or straight away for anything you buy under it). Until then, the July 16, 2026 version continues to apply to you. See section 26.
The short version
- NOPE helps you quit smoking, vaping and other nicotine use. It is not medical care.
- Plans renew automatically until you cancel. You can cancel any time, and the plan stops at the end of the period you've paid for.
- Payments are final, except where the law gives you a right to a refund. That includes the 14-day right of withdrawal for consumers in the EU, EEA and UK, which we honour with a full refund (section 12).
- If you paid through Apple or Google, they handle refunds, not us.
- If a gift or team plan covers you, your access depends on the payer's plan, and the payer never sees your quit data. A team asks you before you join and shows you exactly what it will see.
This summary isn't a substitute for the full terms below. Please read them.

1. Who we are
NOPE (the app, quitwithnope.com and related services, together the "Service") is provided by Bit Microsystems LLC, 3640 Myrtle Avenue, Long Beach, CA 90807, USA ("we", "us"). You can reach us at hello@quitwithnope.com.
These Terms of Use ("Terms") are a contract between you and us. By creating an account, starting a trial, buying a plan, or accepting a gift or team seat, you agree to them. You may use the Service only if you accept these Terms. This is the same whether you sign in in the app or on our website: when you continue at sign-in, you confirm that you're 18 or older and that you accept these Terms. Our Privacy Policy and Consumer Health Data Privacy Policy explain how we handle your information. If you buy for a company, the NOPE for Teams Business Terms also apply.
2. Who can use NOPE
- You must be 18 or older (or the age of majority where you live, if that's higher). By creating an account, or by accepting a gift or team seat, you confirm that you are. This applies to gift recipients and team members too.
- You sign in with your email address and a one-time code. Keep access to your email secure. Anyone who can read your email can sign in as you.
- One person per account. Don't share your account or sell or transfer it.
- Give us accurate information, including the email address you use.
3. NOPE is not medical care
NOPE offers behavioral support: a taper plan, craving tools, progress tracking and encouraging messages. It is not a medical device and does not provide medical advice, diagnosis or treatment. Recovery timelines and health milestones in the app are general estimates from public-health sources. They are not predictions about your body.
Talk to a doctor before changing how you use nicotine, especially if you are pregnant, have a heart or mental-health condition, or take medication. NOPE works alongside nicotine replacement therapy, prescription medication and quitlines, and doesn't replace them. In the US, free help is available at 1-800-QUIT-NOW. If you have a medical emergency, call your local emergency number.
4. How you pay
You can pay for NOPE in one of two ways. Which one you used decides who bills you, how you cancel and who handles refunds.
| Paid by card (on our website or in the app) | Paid through Apple or Google | |
|---|---|---|
| Who bills you | Bit Microsystems LLC. Payments are processed by our payment provider, Stripe. Your statement shows NOPE. | Apple (App Store) or Google (Google Play), under their own terms. |
| How to cancel | In the app, on the web, or by emailing us (section 8). | In your Apple or Google account settings (section 8). |
| Refunds | As described in section 12. | Decided only by Apple or Google under their refund policies. We can't issue or block them. |
Gift plans are paid by card. Team plans are paid by card or, by arrangement, by invoice (see the Business Terms).
5. Prices and taxes
- The price shown at checkout is the price you pay. Prices can differ by country, currency, plan, offer and how you pay. Prices on our website and in our marketing are examples in US dollars.
- If you're a consumer in the EU, EEA or UK, the price shown at checkout includes any VAT. Elsewhere, any sales tax or GST that applies is either included or added at checkout. Either way, you see the total before you pay.
- Your bank may charge foreign-transaction or currency-conversion fees. We don't control those.
6. Free trials
- Some plans start with a free trial. Its length, and the date your first payment is due, are shown before you start. You won't be charged during the trial.
- When the trial ends, your paid plan starts automatically and you're charged the price shown at checkout, unless you cancel before the trial ends. If you paid through Apple or Google, cancel at least 24 hours before the trial ends.
- You can ask the app to remind you before your trial ends. Where the law requires it (for example for consumers in the UK once its new subscription rules apply), we also remind you automatically.
- Free trials are one per person. If you've had a trial before, including under another email address, we may start your plan without one.
7. Automatic renewal
Monthly plans renew every month and annual plans renew every year, automatically, until you cancel. Each renewal is charged at the start of the new period to the payment method on file, at the price that applies at that time (see section 11). Prepaid gifts are different: they never renew (section 14).
For plans billed by us, we email you a reminder with the price and how to cancel: for annual plans, at least 15 days and no more than 45 days before each renewal; for monthly plans, once every 12 months, ahead of the anniversary of your first payment. Every purchase confirmation we email you also explains how to cancel.
8. How to cancel
You can cancel any time. Cancelling stops the next renewal. You keep access until the end of the period you've already paid for (or until your trial ends), and you won't be charged again. Deleting the app from your phone does not cancel a plan.
If you paid by card
- In the app: More → Subscription → Cancel plan.
- On the web: sign in at quitwithnope.com/account with your email and choose Cancel.
- By email: write to hello@quitwithnope.com from the email on your account. We'll cancel it and confirm by email.
When you cancel, we may offer you an alternative, such as a reminder, a longer trial or a pause. You never have to accept one, and you can always finish cancelling.
If you paid through Apple or Google
- iPhone or iPad: Settings → your name → Subscriptions → NOPE → Cancel Subscription.
- Android: Google Play Store → your profile → Payments & subscriptions → Subscriptions → NOPE → Cancel.
We can't cancel store subscriptions for you. Apple and Google require you to cancel at least 24 hours before the renewal date.
Gift and team plans
The person who bought the plan can stop it renewing from Gifts & teams in the app, or at quitwithnope.com/account. Everyone covered keeps access until the end of the paid period.
9. Pausing a plan
If you pay monthly by card, we may offer to pause your plan for one billing period instead of cancelling. You can pause no more than once every six months. During a pause you aren't charged and you don't have access to paid features. Your data stays safe. Your plan resumes and is charged automatically when the pause ends, unless you cancel first. We remind you before the pause ends.
10. Offers and special prices
- We sometimes offer discounts, such as a lower price when you come back after cancelling, a gift discount, or a price agreed with you individually. Each offer's terms are shown when it's offered. They apply only to the plan and account they were offered for, and can't be exchanged for cash.
- Unless the offer says otherwise, an accepted discount stays on your plan while the plan continues without a break. A pause under section 9 doesn't end a discount. If the plan ends, for example because you cancelled, the discount ends with it, unless a later offer says otherwise.
- Personalised prices. Some prices and offers are set automatically for you, for example by how long ago you joined, whether you've subscribed before, or how long ago your plan ended. So an offer you get may differ from the price someone else sees. The price that applies to you is always shown before you pay.
- We may withdraw an offer that hasn't been accepted yet, or refuse one obtained through misuse, such as repeated sign-ups for trials or discounts.
11. Price changes
We may change the price of a plan. If the price of your current plan goes up, we'll email you at least 30 days before the new price first applies to you. The notice will say how to cancel. The change never affects a period you've already paid for. If you don't want to pay the new price, cancel before your next renewal.
For Apple and Google subscriptions, the store also notifies you and may ask you to agree to the new price. If you don't agree, the store cancels the subscription when the current period ends.
12. Payments are final, and your refund rights
Payments are final, except where the law gives you a right to a refund and in the cases described in this section. Once a paid period has started, this includes partly used periods, unused time after you cancel, periods when you didn't use the app, and seats removed from a gift or team plan before the period ends. When you cancel, you keep access until the end of the period you've paid for instead of getting a refund.
When we do refund
- Billing mistakes. If we charged you twice, charged the wrong amount, or charged you after you correctly cancelled, tell us and we'll refund the mistake.
- If we end your plan without cause. If we close your account or stop offering the Service when you haven't broken these Terms, we refund the unused part of your current paid period.
- Where the law requires. Nothing in these Terms takes away rights you have under consumer laws that can't be waived by contract, including rights about faulty digital services.
Goodwill. If we ever give you a refund or credit that these Terms don't require, as a goodwill gesture, it doesn't mean we'll do so again, and it doesn't change these Terms.
Your 14-day right of withdrawal (EU, EEA and UK consumers)
If you live in the European Union, the European Economic Area or the United Kingdom and you buy as a consumer, you have a legal right to withdraw from your purchase within 14 days, without giving a reason. We honour that right.
- When the 14 days start: on the day the contract is made, which is the day you buy. If your plan starts with a free trial, that's the day you start the trial, because that's when you sign up for the paid plan that follows.
- How to withdraw: tell us clearly, before the 14 days end, that you want to withdraw. Email hello@quitwithnope.com from your account email, or write to our postal address. You can use the model withdrawal form below, but you don't have to. We confirm receipt by email. Withdrawing is separate from cancelling. Cancelling only stops future renewals.
- Your refund: we refund the full amount you paid for that purchase, including for any time you've already used, within 14 days of receiving your request, to your original payment method. We don't charge you anything for withdrawing. Your plan ends when we process the withdrawal.
- For a gift, the right belongs to the person who paid for it.
- UK consumers after a free trial: if you live in the UK and your plan started with a free trial, you also have 14 days from your first payment after the trial to withdraw, and we refund that payment in full.
- If the law of your country gives you any other cooling-off period, we honour that too.
This right is for consumers. It doesn't apply to purchases made for a business, including NOPE for Teams. For purchases made through Apple or Google, the store handles withdrawals and refunds.
Apple and Google purchases
If you paid through the App Store or Google Play, only Apple or Google can give you a refund, under their policies. Request one at reportaproblem.apple.com or through Google Play. We can't issue, approve or block store refunds. When Apple or Google ask, we may share information about how the purchase was used, as described in our Privacy Policy.
13. Failed payments and chargebacks
- If a card payment fails, we (or Stripe) will try again and email you. Update your card in the app or at quitwithnope.com/account. If a card payment is still unpaid 14 days after it was due, the plan ends and paid features stop. Gift recipients and team members lose access too. Invoiced team plans follow the Business Terms.
- If you think a charge is wrong, please contact us first. We usually fix it faster than your bank can. If you file a chargeback or payment dispute, we may suspend the plan concerned and stop new purchases on your account while the dispute is open. If the payment is reversed, the plan ends.
- To respond to a dispute, we may give Stripe and your bank or card network the records of the purchase: what you bought and when, the terms you accepted at checkout and when, the country and IP address you bought from, our receipts and emails to you, and dates such as when you signed in and used NOPE. We never share your quit data for this.
14. Gift plans
You can buy NOPE for other people. You're the giver and they're the recipients. There are two kinds of gift:
- Prepaid gift. You pay once for 3, 6 or 12 months per recipient. A prepaid gift never renews and never charges you again. Its term starts on the delivery day (the day the invitation is sent), whether or not the recipient has accepted yet, and it ends on its own when the term is over. The recipient can accept at any time during the term. Time a recipient doesn't use, including a gift that's never accepted, isn't refunded. If a recipient declines, or you remove someone who hadn't accepted yet, you can give what's left of their term to someone else. Before the gift ends, we let the recipient know so they can keep going on their own plan if they want to. They are never charged unless they choose to buy.
- Gift link or code (where we offer it). Instead of entering someone's email address, you can buy a prepaid gift as a single-use link or code and pass it on yourself. Its term starts on the day it's redeemed, and it never renews. Anyone who has the link or code can redeem it, so share it only with the person it's for. Once it's redeemed it can't be taken back. A link or code that's lost, shared with the wrong person or never redeemed isn't refunded, except where the law requires. You see whether and when it was redeemed.
- Recurring gift. You pay monthly or yearly per recipient, and it renews automatically and charges you each period until you stop it. Sections 7, 8 and 11 apply to you as the payer. If a recipient hasn't accepted within 60 days of their invitation, we take them off the gift so you stop paying for them from the next renewal, and we email you so you can invite them again.
Both kinds of gift:
- Who you can gift. Only enter the email addresses of people you know, who are 18 or older, and who you believe would welcome the gift. Don't gift someone who has asked you not to contact them. Use names and messages you'd be happy for the recipient to read.
- Delivery. We email each recipient an invitation, on the delivery date you choose if you choose one, or straight away. The invitation shows your name and message.
- Discount. Any gift discount is shown at checkout. It applies to gifts for other people, not to a plan for yourself.
- Changes. You can add recipients (charged at checkout) and resend invitations. You can remove a recipient. They keep access until the end of the period already paid for, and there's no refund or credit for the unused time (section 12). If you entered a wrong email address, you can remove that person straight away.
- What you see. You see each recipient's email address, the name you entered for them, and whether they've accepted. You never see their quit data, such as their plan, what they log, their cravings or notes.
- If your recipient already pays for NOPE. We tell them how to stop their own plan so they aren't charged twice, but we never tell you whether that's the case. A gift isn't refunded because the recipient already had a plan.
- Recipients can say no. A recipient can decline the gift, using the link in the invitation, or leave it at any time. If they decline, we tell you it was declined and stop emailing them about it. Their seat doesn't come back as a refund.
- Gifts can't be exchanged for cash or resold.
15. If someone else pays for you
If your NOPE access comes from a gift or from your employer or another organisation (a "payer"):
- Your access depends on the payer's plan. It ends if the payer stops renewing, removes you, doesn't pay, or the plan ends. If a team removes you, your access ends straight away. If a gift-giver removes you, you keep access until the end of the period they've paid for. Where we can, we'll tell you before or when that happens, and you can keep going on your own plan. Your progress stays with your account.
- What the payer sees. If the payer invited you by email, they see your email address, the name they typed for you (if they typed one), whether you've been invited, have joined or have declined, and when. They never see the name or nickname you use in NOPE. If you joined through your organisation's email domain or a join link, they see only totals in bands (fewer than 5, 5–9, 10–24, 25–99, or 100 or more), and not who joined. A payer never sees your quit data: no profile, plan, progress, what you log, cravings, slips, journal notes or affirmations.
- Unused domain and join-link seats. If you joined through your organisation's email domain or a join link and don't open NOPE for 120 days, we email you. If you still haven't opened it 14 days later, your seat is released so someone else can use it, and you can join again while seats are free. For this we use only the last date you signed in or opened NOPE, and the payer isn't told who was released.
- If you already pay for NOPE yourself. Your own plan isn't stopped automatically when someone else starts paying for you. We tell you how to stop it, so you aren't paying twice.
- You decide whether to join. Before you join a team, NOPE asks you to confirm and tells you exactly what the organisation will see. Until you tap Join, the organisation only sees that you've been invited. A gift starts when you sign in with the invited email address; you can decline it or leave it instead.
- You can leave at any time in the app or at quitwithnope.com/account. We only tell the payer that a seat became free, not who left. If the payer invited people by email, though, they may notice that you're no longer on their list.
- A seat is personal. You can't transfer it to someone else.
- Your account, data and these Terms stay between you and us. Your employer can't use NOPE to monitor you.
15A. Free and complimentary access
Access we give you free of charge, for example through a promotion, for testing, or under an arrangement with us, can be changed or ended at any time, unless we agreed a fixed period with you. When it ends, nothing is charged unless you choose to buy a plan, and your progress stays with your account.
16. NOPE for Teams
Companies and organisations can buy seats for their people. Team plans are business purchases. They're priced per seat in volume tiers (all seats are charged at the price of the tier you're in) and can be paid monthly or annually, by card or, by arrangement, by invoice. Each team can cover up to the number of seats it has bought. Adding seats is charged straight away; lowering the seat count takes effect at the next renewal. When a team removes someone, their access ends straight away and the seat is free for someone else, with no refund or credit. Team plans are governed by the NOPE for Teams Business Terms, which the purchaser accepts for the organisation. Team members are covered by section 15.
17. Deleting your account
You can delete your account any time: in the app (More → Danger zone → Delete account), at quitwithnope.com/account, or by emailing us from your account email. When you delete your account:
- Plans you pay for by card end immediately, with no refund for unused time (unless section 12 gives you one).
- Apple or Google subscriptions are not cancelled by deleting your account. Cancel them in your store settings, or they'll keep renewing.
- Gifts or teams you pay for stop renewing. The people you cover keep access until the end of the paid period, and we tell them their plan is ending. If you own a team with members, we may ask you to hand ownership to a colleague first.
- If someone else pays for your seat, the seat is released and the payer is told that a seat became free.
- Your profile, plan, history, journal notes and affirmations are erased. Some records we must keep, such as payment and tax records, are described in our Privacy Policy. Deletion can't be undone.
18. Your content and our app
- Your content is yours. This includes your journal notes, profile details and logs. You let us store, process and display it only to run the Service for you, as our Privacy Policy describes.
- Our app is ours. We give you a personal, non-exclusive, non-transferable, revocable licence to use NOPE for your own non-commercial use, under these Terms. The software, design, text, the NOPE name and logo, and other content belong to us or our licensors. Don't copy, modify, reverse-engineer or redistribute them, except where the law allows you to.
- Feedback. If you send us ideas or suggestions, we may use them without owing you anything.
19. AI-written messages
Some messages in NOPE, such as daily affirmations and some emails, are written by an AI model from details in your quit profile, your recent progress and short excerpts of your journal notes (see our Privacy Policy). They're meant to encourage you, and they may sometimes be inaccurate or not quite fit your situation. They are not medical advice. Don't rely on them for health decisions. Tell us if a message is wrong or upsetting.
20. Acceptable use
Please don't:
- break, probe or get around sign-in, security or payment controls, or access accounts or data that aren't yours;
- scrape, overload or automate access to the app or our API;
- resell, sublicense or share access, or misuse trials, offers, gifts or referral codes, including by creating multiple accounts;
- send gift or team invitations to people who haven't agreed to hear from you, or put harassing, hateful, sexual, unlawful, misleading or promotional content in names or messages;
- use the Service to break the law or anyone's rights, or to make others' health information visible to an employer or anyone else.
21. Suspension and termination
- You can stop using NOPE and delete your account any time (section 17).
- We may suspend or close your account, or end a plan, if you seriously or repeatedly break these Terms, if we must for legal reasons, or to protect other users or the Service. Unless the law or safety stops us, we'll tell you why and, where it makes sense, give you a chance to fix the problem first. If you break these Terms, we won't refund the current period.
- We may change or stop offering parts of the Service. If we stop offering NOPE completely, we'll give you at least 30 days' notice where possible and refund any unused prepaid time.
- Sections that by their nature should survive termination continue to apply, including sections 12, 18, 23, 24 and 25.
22. Apple App Store and Google Play
If you downloaded NOPE from Apple's App Store, these extra terms apply between you and us:
- These Terms are between you and Bit Microsystems LLC, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your licence to use the app is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Family Sharing may let other members of your family group use it.
- We, not Apple, are responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, to the extent these Terms don't exclude them.
- We, not Apple, are responsible for addressing any claims by you or a third party about the app or your possession or use of it. That includes product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your possession or use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when you use the app, such as your mobile carrier's.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
- Questions, complaints or claims about the app go to us: Bit Microsystems LLC, 3640 Myrtle Avenue, Long Beach, CA 90807, USA, hello@quitwithnope.com.
If you downloaded NOPE from Google Play, Google Play's terms also apply to your download and to purchases made through Google Play. Google isn't responsible for the app.
23. Disclaimers
We work hard to make NOPE reliable and helpful, but we can't promise that it will help you quit, that it will always be available or error-free, or that every estimate it shows is accurate for you. To the extent the law allows, the Service is provided "as is" and "as available", and we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Some places don't allow these exclusions, so some of them may not apply to you. If you're a consumer in the EU, EEA or UK, you keep your statutory rights for digital services that are faulty or not as described.
24. Limitation of liability
To the extent the law allows:
- we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill; and
- our total liability for all claims about the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$50.
Nothing in these Terms limits liability that can't be limited by law, such as liability for death or personal injury caused by our negligence, or for fraud. If you're a consumer in the EU, EEA or UK, we're responsible for foreseeable loss and damage caused by our breach of these Terms or our failure to use reasonable care and skill.
25. Disputes and governing law
- Talk to us first. Most problems are fixed quickly by email. Before starting a court case, please email hello@quitwithnope.com with a description of the issue. We'll both try in good faith to resolve it within 30 days.
- Governing law. These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules.
- Courts. Any dispute that isn't resolved goes to the state or federal courts located in Los Angeles County, California, and you and we agree to their jurisdiction. Either of us may instead bring an eligible claim in small-claims court.
- If you're a consumer outside the US, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
26. Changes to these terms
We may update these Terms, for example when we add features or the law changes. We post every version on this page and keep earlier versions at quitwithnope.com/legal. If a change materially affects you, we'll tell you by email or in the app at least 30 days before it applies to you, unless it's needed sooner for legal or security reasons. If you don't agree to a change, you can cancel before it takes effect. Changes to prices are covered by section 11, and we'll ask for your agreement where the law requires it.
This version (2026-10-28). It applies straight away to new accounts and to anything bought under it. If you already had an account, it applies to you 30 days after we notify you of it, and until then the July 16, 2026 version applies. The main changes: you can now pay us by card as well as through Apple or Google; we've added gift and team plans; we explain refunds, the EU and UK right of withdrawal, pauses and offers; we name our payment and email providers; we describe how AI messages use your journal notes; and we explain gift links, personalised offers, what a payer sees, when unused domain and join-link seats are released, free access, and the records we may give your bank if you dispute a payment.
27. General
- Entire agreement. These Terms, together with any terms shown at checkout and the policies they link to, are the whole agreement between you and us about the Service.
- Severability. If a court finds part of these Terms unenforceable, the rest stays in effect.
- No waiver. If we don't enforce a right straight away, we can still enforce it later.
- Assignment. You can't transfer your rights under these Terms without our consent. We may transfer ours to a company that takes over NOPE, provided your rights under these Terms aren't reduced.
- Events outside our control. We're not responsible for delays or failures caused by events beyond our reasonable control, such as outages at our providers, natural disasters or government action.
- Notices. We'll send notices to the email address on your account. You can send notices to hello@quitwithnope.com or to our postal address.
- Language. These Terms are written in English. Any translation is for convenience, and the English version applies.
